Acting CJN insists suspended Onnoghen remains substantive CJN

Acting Chief Justice of Nigeria, Justice Tanko Muhammad, has responded to the query from the National Judicial Council, over allegations that he made himself available for swearing-in without recommendation from the commission.

Justice Mohammad in his response to the query maintained that suspended Chief Justice of Nigeria, Justice Walter Onnoghen, remains the substantive Chief Justice of Nigeria.

Justice Mohammad , however, explained that President Muhammadu Buhari did not need the permission of the National Judicial Council to appoint an acting Chief Justice of Nigeria, as he said that the NJC needs to be consulted only when a substantive Chief Justice of Nigeria is being appointed or re-appointed.

Justice Mohammad however declared that he would step aside once the Code of Conduct Tribunal or the Appeal Court rules in favour of Justice Onnoghen.
